Indiana's Access to Public Records Act at IC 5-14-3 protects your right to view court docket records. The clerk must provide access to any record that is not sealed or restricted by law. You can ask to see a docket, get copies, or request certified documents. Most people use certified copies when they need records for another legal proceeding or a government application.

Sealed and Restricted Docket Records

Not all Hamilton County docket records are open to the public. Administrative Rule 9 gives judges the power to seal records when the law calls for it. A sealed case will not show up on MyCase. It will not be available at the clerk's window, either. Juvenile records are restricted under IC 31-39-2, which limits public access to cases involving minors.

Expungement removes records from public view entirely. Under IC 35-38-9, qualifying individuals can petition the court to expunge their criminal records. Once a Hamilton County court grants expungement, the docket entries for that case are wiped from all public databases. The clerk's office will not acknowledge the case exists after that point.
